Federal Judge Clears Trial in $25M Ethereum MEV Bot Fraud Case

Two brothers with MIT backgrounds will stand trial over a $25 million cryptocurrency theft. A U.S. federal judge denied the attempt of accused to dismiss charges related to fraud and money laundering. Anton Peraire-Bueno and James Peraire-Bueno were accused of leveraging technical expertise to corrupt Ethereum’s MEV-Boost protocol.

According to the prosecutors, the theft took place within 12 seconds and involved tricking trading bots into purchasing illiquid tokens. The scheme used false relay signatures to access private transaction data and swap trades to their advantage. According to court filings, the plan targeted three automated MEV trading bots operating on Ethereum.

On July 23, Judge Jessica Clarke ruled that the wire fraud allegations met the required legal standard. The judge explained that the charges addressed a clear scheme involving deception and misrepresentation. She also confirmed that the stolen cryptocurrency represented real property, not just potential earnings. Each brother now faces charges of conspiracy to commit wire fraud, wire fraud, and conspiracy to commit money laundering. If convicted, they could each serve up to 20 years in prison. Their trial is scheduled to begin on October 14.

Brothers Took Time to Plan the Ethereum MEV Bot Fraud Scheme

Investigators revealed that the accused planned the exploit for several months. They studied Ethereum bot activity, formed shell companies, and spent nearly $880,000 in cryptocurrency to set up 16 Ethereum validators. These validators gave them access to block proposals and enabled their execution plan.

The strategy followed a four-step process described as bait, block, search, and propagation. They falsified transactions and misled the bots by selling illiquid assets. They then intercepted pending trades at the relay system using false signatures. This put them ahead, and they introduced their own trades to profit themselves.

Once the trades were completed, the brothers transferred the stolen digital currency through numerous addresses. They exchanged the funds to DAI and further to USDC and used it to transfer 20 million dollars to U.S. bank accounts. They also turned over cash to foreign exchanges with little identity verification, and authorities later seized $3 million of the holdings.

The IRS Cyber Unit was able to detect the transfer of funds despite the attempt of the brothers to cover up the money trail. Special Agent Thomas Fattorusso clarified that investigators employed both sophisticated blockchain tracing and basic methods to track the transactions. He pointed out that the team followed the money and traced it to the brothers.

MEV Risks Continue to Disrupt Blockchain Ecosystems

The case is just one of the increasing crimes in the crypto industry. One recent attack on the UniBTC protocol resulted in a $2 million loss. Meanwhile, Wintermute reported that attackers are now taking advantage of the recent Pectra upgrade to take ETH from wallets with exposed private keys.

Recent data from EigenPhi reported that more than 81,000 users suffered from sandwich attacks over the last 30 days. In addition, 2,886 sandwich attacks happened on July 23. These attacks are now adding around $1 billion in weekly trading volume on Ethereum-based exchanges. 

According to Flashbots research, a research and development organization, MEV bots now take 40% of blockspace on Solana and more than 50% of gas consumption on Ethereum rollups. Flashbots has suggested countermeasures such as explicit MEV auctions and privacy protections using trusted execution environments.
